Maine bill aims to ban transgender athletes from girls' school sports

AUGUSTA (WGME) -- A bill aims to ban transgender athletes from playing on girls’ or women’s school sports teams in Maine.

The bill called “An Act to Ban Biological Males from Participating in Women's Sports," which was introduced by Representative Beth O’Connor, seeks to bar transgender girls’ from participating in elementary, secondary and post-secondary school sports.

“This bill prohibits any student from joining or participating in an interscholastic or intramural athletic team or sports activity sponsored by an elementary or secondary school or postsecondary institution that is designated for "females," "women" or "girls" except for students of the female gender,” according to the bill.

The bill would also require a medical examination for any student who is excluded from participation on a girls’ or women’s team.

“A student prohibited from joining or participating in an athletic team or sport activity on the basis that the student is not a female may dispute the denial to the Commissioner of Education with a signed statement from a physician stating that the student is a female based upon the student's internal and external reproductive anatomy and naturally occurring level of testosterone and an analysis of the student's chromosomes,” according to the bill.

Some Maine civil rights and community organizations are speaking out against the proposed legislation.

“As Mainers we all want fairness in school sports, but this bill isn’t fair, it’s harmful to young people. Not only would the bill exclude some girls and young women from important developmental opportunities because of who they are, it would subject any girl who wants to challenge that exclusion to a prying and privacy-invading medical exam,” said Gia Drew, the program director at EqualityMaine.
“This bill is misguided and harmful. Efforts to ban trans girls from participating in girls’ sports jeopardize their mental health, physical well-being and ability to access education opportunities similar to other students. All children, including trans children, belong in Maine.” Meagan Sway, the policy pirector for the ACLU of Maine, added.
