Appeal to be heard in 1994 murder case
PORTLAND (WGME) -- A man convicted of a 1994 murder is making another appeal in the case.
Foster Bates was found guilty of killing Tammy Dickson of South Portland.
Dickson was found bound, gagged, and strangled in her apartment.
Twelve years later, in 2002, Bates was sentenced to life in prison.
In an appeal to the Superior Court last year, Bates claimed the jury was racially biased.
His defense also pointed to new DNA evidence from the scene.
The court denied his motion for a new trial.
Tuesday, Bates will appeal that ruling, saying the court failed to consider all the evidence in the case.
